Short Term Rental Agreement
This Short Term Rental Agreement (the “Agreement”) is made by and between Rio de Arcadia, LLC (“Property Owner”, “Homeowner”, “We” or “Us”) and the guest (“You” or “Guest”) as of the date submitted in the online Booking request. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
PROPERTY
You have rented the Property at 2031 Arcadia Loop, Kerrville, TX referenced in the online Booking request.
MAXIMUM OCCUPANCY & MINIMUM AGE
The maximum number of guests is limited to the number specified in the online Booking request. People other than those in the pre-approved guest party may not stay overnight in the Property. Any other person in the Property is the sole responsibility of Guest. A $20.00 per night additional fee will be charged for each additional overnight guest. The person making the reservation must be at least 25 years of age. Each house rented must have at least one guest 25 years of age staying in that house and be responsible for that house, unless We waive that condition in writing.
TERM OF THE LEASE
The lease begins on the “Check-in Date” and ends on the “Check-out Date”, as referenced in the online Booking request. We will charge You for an extra day at our maximum rental rate if You have not vacated the Property by the Check-out Time.
HOUSE RULES
You agree to abide by the House Rules, attached as Exhibit A, at all times while at the Property and shall provide all members of the rental party with a copy of the House Rules and shall cause all members of the rental party and anyone else You permit on the Property to abide by the House Rules at all times while at the Property.
NOTIFICATION OF REPAIR ISSUES AND ACCESS
You agree to notify us immediately of any issues needing repair. You will allow us access to the Property for purposes of repair and inspection. We will exercise this right of access in a reasonable manner.
RENTAL RATE AND FEES

Deposit: A security deposit in the amount of $500.00 is due at booking. The security deposit will be returned to You via your original payment method within 14 days of the Check-out Date. We reserve the right to keep all or part of Your security deposit for:
- i. damage to the property or furnishings (damage to the Property by occupants or guests are Your responsibility)
- ii. dirt or other mess requiring excessive cleaning, or
- iii. any other cost incurred by Us due to Your stay.
If damage is done in excess of the amount of the security deposit, You will be held responsible for paying any additional amount to cover repair or replacement as reasonably determined by Us. You will be held responsible for any missing item(s) and theft will be prosecuted.
- Rental Rate: Payment of the Rental Fee is due in full on or before 30 days prior to your Check-In Date.
CANCELLATION POLICY
If You wish to cancel your reservation, the deposit will be refunded to You as follows:
- 100% if cancelled at least 30 days or more prior to the Check-in Date
- 50% if cancelled less than 30 days but more than 7 days prior to the Check-in Date
- No refund will be given if You cancel less than 7 days prior to Your Check-in Date
No refunds or rate adjustments will be made due to equipment failure, inclement weather, early departures, delayed arrivals or other unforeseen circumstances. If You cancel Your event or stay Your security deposit will be refunded to You in full in the form of the original payment within 14 days of Your cancellation.
LOSS OR DAMAGE & RISK
We do not accept any liability for loss of or damage to any valuables or property belonging to You or other guests. It is the sole responsibility of all guests to make arrangements for sufficient and appropriate insurance coverage on all of Your valuable items prior to arrival at the Property. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises.
TERMINATION BY OWNER
Rio de Arcadia and its Owners reserve the right to terminate this Agreement and retain the deposit in the event that unruly behavior occurs that can or has injured a person, the Property or its contents. Guests shall not disturb or offend any neighbors. In order to preserve the peaceful surroundings, we reserve the right to refuse service or terminate rentals for drunken, loud, or unruly behavior. Furthermore, You and Your guests/attendees at any event or stay must comply with reasonable requests made by Us to ensure the orderliness or success of the event/stay or for the protection of the Property, its contents or the grounds. Failure to comply will result in termination of this Agreement at Our option.
INDEMNITY AND HOLD HARMLESS
In consideration of access and use of the available amenities on the Property including the swimming pool, hot tub, fire pit, deck, grill, and river for use in any stay, You waive, release and agree not to sue and agree to indemnify and hold harmless Property Owner and its members, employees and agents from any claims, actions, suits, costs, expenses, damages or liabilities, including attorney’s fees for personal injury, property damage, accidents, illnesses, or death to Yourself or any of Your guests. This is a complete and unconditional release of all liability to the greatest extent allowed by law. We shall not be liable for events beyond our control which may interfere with Your visit. This may include but is not limited to Acts of God, acts of governmental agencies, fire, war, inclement weather and construction noise.
ROUTINE HOUSE CLEANING
Guests are responsible for routine light cleaning and straightening such as washing dishes and placing garbage and recyclable materials in the appropriate outside containers. No daily housekeeping service is provided.
REPAIRS/SERVICE CALLS
We cannot guarantee against mechanical failure of equipment such as heating, air conditioning, TV’s or other appliances, hot tub or swimming pool. Please report any equipment that is not operating properly and We will make every effort to resolve the problem as quickly as possible.
KEYS AND TELEPHONE
All keys must be returned to Us or placed on the kitchen counter by the sink upon departure. For lost, misplaced or unreturned keys, the Property must be re-keyed. You will be responsible for the cost of this procedure. No land-line telephone is available on the Property.
SMOKING
Positively NO SMOKING is permitted within 20 feet of any structure on the Property. If We find that there has been smoking inside any structure, We will charge you a cleaning fee of $500 plus any other costs that We reasonably incur to clean up the smoke damage.
PETS
Service animals are permitted. Dogs, cats or other pets are not permitted – NO EXCEPTIONS. Any violation of this policy is cause for immediate termination of tenancy with no refund and full and immediate liability for any additional cleaning necessary and all damages incurred by said animal(s).
CHECK-OUT PROCEDURES
Please load the dishwasher with dirty dishes. No dirty dishes should be left in the sink or on the countertops. Please bag all garbage and place in outside garbage can. Please pick up all outside litter and place in garbage bags inside garbage can. Please lock all doors and windows and turn off all lights and fans.
This policy is subject to change as seen fit by Rio de Arcadia.
